HB3387 and it’s impact on South Carolina Campgrounds
Please read the following notice about South Carolina Law HB3387 and it’s implications for South Carolina campgrounds.
Understanding Section 45-2-65. Key Points for Campgrounds:
- Guests are considered “transient” not tenants.
– The law distinguishes campground/ RV Park guests from residential tenants.
– That means campground operators do not have to go follow traditional landlord-tenant eviction procedures when removing a guest from the property. They do not have to go through the long landlord-tenant eviction process. - Campgrounds can remove problem guests
Operators may remove a guest (or have them removed if they):
– Possess or distribute illegal drugs
– Disturb the peace or other campers
– Violate posted campground rules
– Fail to follow campground policies or pay fees. - 3. Law enforcement can assist
If the guest refuses to leave after being directed to do so, law enforcement may assist in removal.
Guidelines that campgrounds need to follow:
- Post campground rules clearly at registration and online,
- Have written policies on disturbances, non-payment, and illegal activity
- Document warnings given to guests
- Contact Law enforcement if a guest refuses to leave.
- Make a copy to explain to your local law enforcement officers and judges that may not yet be familiar with the change.
